1. Acceptance of Terms

By creating an account or using the FOXii service (the "Application" or "Service"), you agree to be bound by these Terms and Conditions. If you do not agree, you may not use the Application.

2. Service Description

FOXii is a cloud-based application designed for service and installation companies, providing:

• Digitalization of service processes and customer data
• Technician work scheduling in calendar and map views
• Creation and management of service reports
• Regular maintenance management and notifications
• Technician efficiency and workload tracking
• Mobile and tablet access to all data
• GPS navigation to customer locations
• Digital service protocols with customer signatures
• Automated service reminders for equipment

3. Account Registration

To access the full Service, you must create a business account. You are responsible for:

• Accuracy of provided information (company name, business ID, contact details)
• Confidentiality of your login credentials
• All activities under your account
• Ensuring your employees (technicians) use the system in compliance with these Terms
• Immediately notifying us of any unauthorized use

4. Acceptable Use

You agree to use the Application only for legitimate business purposes. Prohibited activities include:

• Entering false or misleading service information
• Violating copyrights or trademarks
• Attempting to gain unauthorized access to other users' systems or data
• Using the Application for illegal activities
• Exceeding allocated storage capacities
• Interfering with the Service's operation or security
• Using bots, scrapers, or automated means to access data without permission

5. Customer Data Responsibility

When using the Application, you process personal data of your customers. You are responsible for:

• Complying with GDPR and obtaining proper consents for data processing
• Having legal authority to process this data
• Ensuring data accuracy and currency
• Properly informing customers about data processing

6. Service Reports and Digital Signatures

The Application enables creation of service reports and collection of digital signatures. You are responsible for:

• Legal validity and content of service reports
• Validity of digital signatures according to applicable legislation
• Proper archiving of reports for required legal periods
• Obtaining customer consent for digital signatures where required

7. Geolocation and Tracking Features

The Application uses GPS for technician navigation and service tracking. You agree to:

• Inform your employees about location tracking
• Comply with labor regulations regarding employee monitoring
• Respect customer privacy when visiting service locations
• Obtain necessary consents for location data processing

8. Payment and Billing

Details regarding pricing, billing, and payment terms are specified in your service agreement and invoices. We use secure payment processors for all transactions.

9. Service Termination

You may cancel the Service according to the terms in your agreement. Upon termination:

• Access to the Application will cease on the agreed date
• You have the right to export your data in CSV/PDF format for 30 days after termination
• Data will be anonymized after legal retention periods expire
• Outstanding payments remain due

10. Intellectual Property

All content, features, and functionality of the FOXii Application are owned by FOXii or its licensors and are protected by copyright, trademark, and other intellectual property laws.

11. Third-Party Services

The Service may integrate with or link to third-party services (maps, SMS gateways, payment processors). We are not responsible for their content, policies, or practices.

12. Disclaimer of Warranties & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, FOXII DISCLAIMS ALL WARRANTIES.

WE ARE NOT RESPONSIBLE FOR:

• Direct or indirect losses caused by service interruptions
• Inaccurate data entered by users
• Failure to fulfill customer obligations due to Application use
• Technical issues on the user side (internet connection, devices)
• Loss of data not caused by our negligence

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or in-application notification at least 30 days before they take effect.

14. Governing Law

These Terms shall be governed by the laws of the Slovak Republic. Any disputes shall be resolved before the competent courts in Slovakia.
